PROCLAMATION AND DECLARATION OF LOCAL STATE OF DISASTER

WATER SHORTAGE EMERGENCY

(SEVERE DROUGHT AND IMMINENT PUBLIC WATER SUPPLY FAILURE)

WHEREAS, the City of Beeville, Texas, is a municipal corporation located in Bee County, Texas, which provides potable water service to approximately 13,129 residents and essential community facilities within Bee County, and depends upon surface water from Lake Corpus Christi as its primary source of raw water for municipal treatment and distribution; and

WHEREAS, current severe drought conditions and extreme hydrologic deficits across South Texas, along with sustained low inflows to Lake Corpus Christi, have resulted in declining lake elevations, which are forecasted to continue dropping through late 2025; and

WHEREAS, engineering projections indicate that by December 2025, water levels may fall below the elevation of the City’s existing raw water intake structure, threatening the City’s ability to withdraw and treat sufficient water to meet basic health, sanitation, and firefighting needs—thereby constituting a threat of imminent failure of the City’s public water supply system as recognized under State emergency response criteria; and

WHEREAS, the City has secured professional engineering services and is pursuing long-term groundwater well development to diversify and strengthen its future water supply, but construction and financing timelines will prevent those projects from being operational until early 2026; and

WHEREAS, the anticipated timing gap between the operability of the existing lake intake and the completion of alternative supply projects creates an imminent threat to the health, safety, and welfare of the citizens of Beeville; and

WHEREAS, this declaration is intended to qualify the City of Beeville for consideration under the Texas Water Development Board’s Emergency and Urgent Need Fund and the Drinking Water State Revolving Fund (DWSRF) emergency set-aside program; and

WHEREAS, the City Council finds that extraordinary measures must be taken to prepare for and respond to this emergency situation, and that the declaration of a local disaster will enable the City to access emergency assistance, technical support, and funding through the Texas Division of Emergency Management (TDEM), the Texas Commission on Environmental Quality (TCEQ), the Texas Water Development Board (TWDB), the Office of the Governor, and the Texas Emergency Drinking Water Task Force; and

WHEREAS, pursuant to the authority granted under Chapter 418 of the Texas Government Code, the Mayor of the City of Beeville is empowered to declare a local state of disaster when the occurrence or imminent threat of disaster is determined to exist within the City; and

WHEREAS, this declaration shall be submitted to the Office of the Governor of Texas, The Honorable Greg Abbott, to request state-level assistance and coordination of additional resources to address the City’s water shortage emergency.

NOW, THEREFORE, BE IT PROCLAIMED AND DECLARED BY THE MAYOR OF THE CITY OF BEEVILLE, TEXAS:

1. Declaration of Disaster:
   A Local State of Disaster is hereby declared for the City of Beeville, Texas, pursuant to Section 418.108(a) of the Texas Government Code due to the imminent loss of the City’s primary water supply source as a result of sustained drought and declining lake levels.

2. Duration:
   Pursuant to Section 418.108(b) of the Texas Government Code, this declaration shall remain in effect for seven (7) days from the date of issuance unless continued or renewed by the City Council of the City of Beeville.

3. Publicity and Filing:
   In accordance with Section 418.108(c) of the Texas Government Code, this declaration shall be given prompt and general publicity and shall be filed immediately with the City Secretary, the Bee County Clerk, and certified copies shall be transmitted to the Office of the Governor, the Texas Division of Emergency Management, the Texas Commission on Environmental Quality, and the Texas Water Development Board.

4. Activation of Emergency Management Plan:
   Pursuant to Section 418.108(d) of the Texas Government Code, this declaration activates the City of Beeville Emergency Management Plan and authorizes the furnishing of aid and assistance under the plan.

5. Coordination Authority:
   The City Manager and designated staff are authorized to coordinate directly with TDEM, TCEQ, TWDB, and the Office of the Governor to obtain emergency funding, regulatory flexibility, and technical assistance necessary to maintain reliable public water service.

6. Procurement Authority:
   Pursuant to Texas Local Government Code § 252.022(a)(2), the City may procure goods and services necessary to preserve and protect the public health and safety without the standard competitive bidding procedures for the duration of this declaration.

7. Legislative Support:
   The City further acknowledges and appreciates the assistance and representation of Senator Adam Hinojosa and Representative J.M. Lozano in advocating for the City’s emergency needs at the State level.

8. Effective Date:
   This proclamation shall take effect immediately upon issuance.

PROCLAMACIÓN Y DECLARACIÓN DE ESTADO LOCAL DE DESASTRE
EMERGENCIA POR ESCASEZ DE AGUA
(SEQUÍA SEVERA Y FALLA INMINENTE DEL SUMINISTRO PÚBLICO DE AGUA)

CONSIDERANDO que la Ciudad de Beeville, Texas, es una corporación municipal ubicada en el Condado de Bee, Texas, que proporciona servicio de agua potable a aproximadamente 13,129 residentes e instalaciones comunitarias esenciales dentro del Condado de Bee, y depende del agua superficial del Lago Corpus Christi como su fuente principal de agua cruda para tratamiento y distribución municipal; y

CONSIDERANDO que las actuales condiciones severas de sequía y los déficits hidrológicos extremos en el sur de Texas, junto con un flujo de entrada sostenidamente bajo al Lago Corpus Christi, han provocado una disminución en los niveles del lago, los cuales se prevé que continúen bajando hasta finales de 2025; y

CONSIDERANDO que las proyecciones de ingeniería indican que para diciembre de 2025 los niveles de agua podrían caer por debajo de la elevación de la estructura de toma de agua cruda existente de la Ciudad, lo que amenazaría la capacidad de la Ciudad para extraer y tratar suficiente agua para satisfacer las necesidades básicas de salud, saneamiento y extinción de incendios, constituyendo así una amenaza de falla inminente del sistema de suministro público de agua de la Ciudad, según lo reconocido por los criterios estatales de respuesta a emergencias; y

CONSIDERANDO que la Ciudad ha contratado servicios profesionales de ingeniería y está desarrollando proyectos de pozos de agua subterránea a largo plazo para diversificar y fortalecer su suministro futuro de agua, pero los plazos de construcción y financiamiento impedirán que dichos proyectos estén operativos hasta principios de 2026; y

CONSIDERANDO que la brecha temporal anticipada entre la operatividad de la toma de agua existente y la finalización de los proyectos de suministro alternativo crea una amenaza inminente para la salud, seguridad y bienestar de los ciudadanos de Beeville; y

CONSIDERANDO que esta declaración tiene el propósito de calificar a la Ciudad de Beeville para consideración bajo el Fondo de Emergencia y Necesidad Urgente de la Junta de Desarrollo del Agua de Texas (TWDB) y el Programa de Fondos Rotatorios Estatales para Agua Potable (DWSRF) en su programa de emergencia; y

CONSIDERANDO que el Ayuntamiento considera que se deben tomar medidas extraordinarias para prepararse y responder a esta situación de emergencia, y que la declaración de un desastre local permitirá a la Ciudad acceder a asistencia de emergencia, apoyo técnico y financiamiento a través de la División de Manejo de Emergencias de Texas (TDEM), la Comisión de Calidad Ambiental de Texas (TCEQ), la Junta de Desarrollo del Agua de Texas (TWDB), la Oficina del Gobernador, y el Grupo de Trabajo de Emergencia de Agua Potable de Texas; y

CONSIDERANDO que, de acuerdo con la autoridad otorgada bajo el Capítulo 418 del Código de Gobierno de Texas, el Alcalde de la Ciudad de Beeville está facultado para declarar un estado local de desastre cuando se determine la ocurrencia o amenaza inminente de un desastre dentro de la Ciudad; y

CONSIDERANDO que esta declaración será presentada a la Oficina del Gobernador de Texas, El Honorable Greg Abbott, para solicitar asistencia a nivel estatal y la coordinación de recursos adicionales para abordar la emergencia de escasez de agua de la Ciudad.

POR LO TANTO, SE PROCLAMA Y DECLARA POR EL ALCALDE DE LA CIUDAD DE BEEVILLE, TEXAS:

1. Declaración de Desastre:
   Se declara por la presente un Estado Local de Desastre para la Ciudad de Beeville, Texas, de conformidad con la Sección 418.108(a) del Código de Gobierno de Texas, debido a la pérdida inminente de la fuente principal de suministro de agua de la Ciudad como resultado de la sequía sostenida y la disminución de los niveles del lago.

2. Duración:
   De conformidad con la Sección 418.108(b) del Código de Gobierno de Texas, esta declaración permanecerá en vigor durante siete (7) días a partir de la fecha de su emisión, a menos que sea continuada o renovada por el Ayuntamiento de la Ciudad de Beeville.

3. Publicidad y Registro:
   De acuerdo con la Sección 418.108(c) del Código de Gobierno de Texas, esta declaración deberá ser divulgada de manera pronta y general, y deberá archivarse de inmediato con la Secretaria de la Ciudad, el Secretario del Condado de Bee, y copias certificadas deberán transmitirse a la Oficina del Gobernador, la División de Manejo de Emergencias de Texas, la Comisión de Calidad Ambiental de Texas y la Junta de Desarrollo del Agua de Texas.

4. Activación del Plan de Manejo de Emergencias:
   Conforme a la Sección 418.108(d) del Código de Gobierno de Texas, esta declaración activa el Plan de Manejo de Emergencias de la Ciudad de Beeville y autoriza la prestación de ayuda y asistencia bajo dicho plan.

5. Autoridad de Coordinación:
   El Administrador de la Ciudad y el personal designado están autorizados para coordinar directamente con TDEM, TCEQ, TWDB y la Oficina del Gobernador a fin de obtener financiamiento de emergencia, flexibilidad regulatoria y asistencia técnica necesarias para mantener un servicio público de agua confiable.

6. Autoridad de Adquisición:
   De conformidad con el Código de Gobierno Local de Texas § 252.022(a)(2), la Ciudad podrá adquirir bienes y servicios necesarios para preservar y proteger la salud y seguridad públicas sin los procedimientos estándar de licitación competitiva durante la vigencia de esta declaración.

7. Apoyo Legislativo:
   La Ciudad reconoce y agradece la asistencia y representación del Senador Adam Hinojosa y del Representante J.M. Lozano en la defensa de las necesidades de emergencia de la Ciudad a nivel estatal.

8. Fecha de Vigencia:
   Esta proclamación entrará en vigor inmediatamente a partir de su emisión.
